KVKK generative AI guide (Nov 2025): reusing data for a new model is tested against the original purpose, and legitimate interest is no catch-all (Personal Data Protection Authority (KVKK), Generative Artificial Intelligence and Protection of Personal Data Guide in 15 Questions, Publication No. 113, November 2025 (in Turkish), answer on the principle of purpose limitation)
Translation: if data collected to train one model is later wanted for training another, the compatibility of that secondary use with the original purpose must be assessed, the data subject's reasonable expectations must be considered, and if the later processing is not compatible the controller must set a new processing basis. A licence of support tickets or call recordings to a third party for its own model is further from the original purpose than the guide's own example (my reading). The guide also says legitimate interest is neither a last resort nor a catch-all and that the benefit should not be aimed only at profit or economic gain, so a licence fee is a weak ground for it (my reading); a case-by-case balancing test is required.
